STANDARD COMPETITION TERMS AND CONDITIONS:

Caroma Plumbing Innovations Roadshow Major Prize Draw – $5000 egift card

  1. The “Caroma Plumbing Innovations Roadshow Major Prize Draw” (Promotion) is conducted by GWA Group Limited (ABN 68 009 659 385) of Level 24/100 Mount St, North Sydney NSW 2060, telephone 13 14 16 (Promoter).
  2. The Promotion runs from Wednesday 6 March 2024 to Tuesday 26 March 2024 (Promotional Period), and the prize draw will take place on Monday 1 April 2024. 
  3. Information on how to enter the Promotion, the prize/rewards and rules for redeeming the prize/rewards form part of these terms and conditions. By entering this Promotion, you accept and agree to these terms and conditions.

Eligibility / how to enter

  1. Entry is open to Australian and New Zealand residents who:
    1. are aged 18 years or over at the commencement of the Promotional Period;
    2. are a licensed / registered plumber or plumbing apprentice;
    3. attend any of the Caroma Plumbing Innovations Roadshow events during the Promotional Period; and
    4. are not a person that is (as determined by the Promoter):
      1. an employee of the Promoter, its related entities or any agencies associated with this Promotion;
      2. an immediate family member of any person mentioned in clause 4.c.i above (in this clause, immediate family member means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin); or
      3. involved (whether as a principal, agent or employee) in the conduct or the promotion of the Promotion (including any person who determines who is to win a prize in the Promotion),

("Eligible Entrants").

  1. To enter the Promotion, Eligible Entrants must, during the Promotional Period, satisfactorily complete the “attendance and prize entry form” available from the Caroma Plumbing Innovations Roadshow, and submit this form along with their details to the Promoter (or any of its related bodies corporate).
  2. Each Eligible Entrant is only eligible to enter the Promotion once for each draw. Eligible Entrants may enter more than one draw. 

Prize details

  1. The first eligible entry randomly drawn will win either a AU$5000 egift card from Total Tools (if the winner is an Australian resident) or a NZ$5000 egift card from The Tool Shed (if the winner is an New Zealand resident) ("Prize"). The total value of the Prize in the Promotion is either AU$5000 or NZ$5000, as the case may be. 
  2. The Prize is not transferable, exchangeable or otherwise redeemable for cash, unless otherwise specified, and is subject to any additional terms and conditions that apply to the Prize, including the conditions for using the relevant egift card.
  3. If the Prize, or any element of the Prize, is unavailable, the Promoter reserves the right, in its discretion, to substitute the Prize, or that element of the Prize, with a prize of equivalent value and/or specification, subject to any legal requirements or any written directions from a regulatory authority.
  4. To claim the Prize, the winner may be asked to provide proof of eligibility, including proof of identification and Plumber license number.

 

Determining winners

  1. The random electronic prize draw will take place at Level 24/100 Mount St, North Sydney NSW 2060 on the date set out in clause 2 at 1.00pm AEDT (“Draw”). The first eligible entry drawn will be awarded a Prize ("Winner").
  2. At time of the Draw, the Promoter will randomly draw an additional eligible entry and record it in case:
    1. an invalid entry or ineligible entrant is drawn; or
    2. the Winner cannot be contacted or does not claim their Prize in accordance with clause 14 below,

("Reserve Winner").

Announcing / notifying winners

  1. Winners will be notified by email and phone within seven (7) days of the Draw, and their name may also be published online at our Instagram Page (@Caroma Industries) from the same date.

Claiming the Prize

  1. The Winner must claim the Prize by 1.00pm (AEDT) on the last business day of the month the Prize was awarded to them by confirming receipt of the notification email by return email or by such other method specified in the notification email.  
  2. If a Prize is not claimed in that time:
    1. the Winner will be taken to have forfeited the Prize and the Promoter will award the Prize instead to the Reserve Winner to have been next drawn;
    2. the Promoter will notify that Reserve Winner by email and phone within five (5) days of the Prize being awarded to them, and will publish their name in the manner described in clause 13 above. 
  3. If a Reserve Winner is not contactable or does not claim their Prize within the requisite timeframe as specified by the Promoter in its sole discretion, the process set out in clause 15 shall be applied again, and so on until the Prize has been successfully delivered to a Reserve Winner.
  4. As a condition of claiming the Prize, each Winner or Reserve Winner (as the case may be) ("Prize Recipient"), must:
    1. consent to the publication of their name in accordance with these terms; and
    2. consent to the Promoter using the Prize Recipient's name, likeness, image and / or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

Distributing the Prize

  1. The Prize will be provided to Prize Recipient by email within fourteen (14) days of the Prize Recipient claiming the prize.

Resolving disputes

  1. Complaints regarding the Promotion may be submitted by email addressed to the Promoter’s Company Secretary and General Counsel ([email protected]).
  2. If there is a dispute concerning the complaint, the decision of the Promoter is final and binding, and no further correspondence will be entered into.

General

  1. Any entry which does not comply with these terms and conditions is invalid. Incomplete, indecipherable, or illegible entries will be deemed invalid.
  2. By entering the Promotion, each Eligible Entrant warrants that each entry is not offensive, inappropriate, defamatory, does not infringe the rights of any third-party including copyright or trademark rights, or is not otherwise against the law. The Promoter may, in its sole discretion, remove an entry from any platform, or disqualify an entrant for an entry, that it deems to be offensive, inappropriate, defamatory, that infringes the rights of any third-party including copyright or trademark rights, or is otherwise against the law.
  3. Entries are deemed to be received at the time of receipt by the Promoter. The Promoter is not responsible for failure to receive any entry, whether for any cause beyond its control or otherwise.
  4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these terms and conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  5. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  6. Entering the Promotion does not guarantee that an Eligible Entrant will win a Prize or derive any other benefit.
  7. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth) or the New Zealand Consumer Guarantees Act 1993, as well as any other non-excludable rights under the ASIC Act 2001 (Cth) or any similar consumer protection laws in the States and Territories of Australia or New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  8. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize or Reward value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use / taking of the Prize or Reward.
  9. If the Promotion is not able to be run as planned, whether caused by computer virus, line drop-out or congestion, tampering, unauthorised intervention, fraud, technical failures, or other cause beyond the control of the Promoter which affects the administration, security, fairness or integrity of the Promotion, the Promoter may cancel, terminate, modify, or suspend the Promotion. The Promoter may disqualify any individual who tampers with the entry process.
  10. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
  11. The Promoter collects personal information ("PI") to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.caroma.com.au/privacy and https://www.caroma.co.nz/privacy.   In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.
  12. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
